Acceptance of Terms

By submitting payment for the booking fee (deposit) or any portion of the invoice, the Client confirms that they have reviewed and accepted these Terms and Conditions.
A physical signature is not required; payment acts as acknowledgment and agreement to all outlined terms’’

General Information

Service Provider: The term “we,” “us,” or “our” refers to the balloon decoration company.
Client: The term “you” or “your” refers to the person or entity requesting services from us.
Agreement: By booking our services, you agree to comply with and be bound by the following terms and conditions.
These Terms and Conditions (“Agreement”) govern the provision of event styling services by Eveia Occasions Ltd (“the Company”) to the Client. By booking our services, the Client agrees to be bound by the following terms and conditions.

1. Booking and Payment
1.1 Booking Confirmation:
A booking is considered confirmed once the Client has signed the rental agreement and paid a non-refundable booking fee of 50% or more of the total rental fee. The remaining balance is due 7 days prior to the event date unless otherwise agreed in writing.
1.2 Payment Terms:
Payments can be made via bank transfer. All payments must be completed in full before the event setup, unless otherwise agreed in writing. Payments should be made in full no less than 7 days before the event. The service will not be provided unless paid in full on or before the agreed date. If the booking is accepted less than 7 days before the event date, the payment must be made in full.
1.3 Pricing:
Prices for prop hire are agreed upon prior to booking. The total hire fee will include the cost of the props, delivery, setup, and collection, unless otherwise specified. Any additional costs, such as damages or late return fees, will be charged separately.
1.4 Refundable Damage Deposit:
a. The minimum refundable damage deposit of £100 is required and must be paid in full no later than 3 days before the event date. This deposit is separate from the service fee and is intended to cover any damage to balloon structures, decor, rental items, or venue property caused during the event. For larger events the damage deposit may exceed £100 and will be agreed with in advance of the non-refundable booking fee.
b. The deposit will be refunded within 5 working days following the event, provided there is no damage, loss, or excessive mess caused by the balloons or guests interacting with them.
c. If any damage or loss is identified, the Client will be notified in writing with a breakdown of the costs to be deducted from the deposit. Any charges exceeding the deposit amount will be the responsibility of the Client.

2. Cancellations and Refunds
2.1 Cancellation by the Client:
If the Client cancels the booking, the booking fee is non-refundable.
Cancellations made less than 14 days before the event will incur a cancellation fee of 50% of the remaining balance.
2.2 Cancellation by the Company:
In the unlikely event that Eveia Occasions Ltd must cancel the booking, the Client will receive a full refund of any payments made, including the booking fee.
2.3 Rescheduling:
If the Client wishes to reschedule the event, Eveia Occasions Ltd will make every effort to accommodate one new date, subject to availability. Additional fees may apply if the new date requires a change in the scale or complexity of the decoration. The client will be liable for any fees incurred as a result of rescheduling including but not limited to, the purchase of stock, van or equipment hire. Invoices for such fees will be provided to the client.

3. Rental/Hire Period
3.1 Rental/Hire Duration:
The standard rental period for props is for up to 36 hours. If the Client requires the props for a longer period, additional rental fees may apply.
3.2 Overdue Returns:
Props must be returned on the agreed date and time. If the Client fails to return the props on time, an additional late fee of £100 per day will be charged until the props are returned.

4. Set Up/Delivery and Collection
4.1 Delivery:
The Company will deliver the hired props to the Client’s event location at the agreed time and date. The Client is responsible for providing access to the location and ensuring that there is adequate space for the props.
4.2 Collection:
The Company will collect the props after the event at the agreed-upon time. The Client is responsible for ensuring that the props are available for collection and properly packed, if required.
4.3 Access and Setup:
The Client must ensure that the venue allows for the installation and setup of props. Any necessary access permissions or requirements (e.g., parking arrangements, loading bays, etc.) must be provided to the Company in advance. If additional time or resources are needed for delivery or collection, additional charges may apply.
4.4 Failure to provide timely access may result in delays or limitations in the ability to deliver the services in full. In such cases, The Company reserves the right to modify or reduce the scope of the services as necessary. Any such modifications are not considered a fault or breach of contract by The Company, and no refunds or compensation will be issued for changes resulting from access delays caused by the Client or the venue.

5. Care and Handling of Props
5.1 Client Responsibility: The Client agrees to take reasonable care of the props during the rental period. The props must be kept in a safe environment, away from excessive heat, moisture, and other damaging conditions. Any damage to props caused by improper handling will result in the Client being charged for repairs or replacement.
5.2 The Client agrees not to leave props outside overnight or unattended in public places or in any such place that props can be damaged.
5.3 Cleaning and Maintenance: Eveia Occasions will ensure that the props are clean and in good condition before delivery. The Client agrees not to alter, modify, or attempt to repair the props during the rental period. The Client must return the props in the same condition as they were provided, with the exception of normal wear and tear.
5.4 Damage or Loss:
If the props are returned damaged or missing, the Client will be charged for the full cost of repair or replacement, plus any associated shipping costs.
The Client is also responsible for any costs incurred due to props being lost or returned in an unusable condition (e.g., stained, broken, or irreparably damaged).
The Client agrees not to leave props outside overnight or unattended in public places, or in any location where the props may be exposed to theft, vandalism, adverse weather conditions, or other environmental factors that may cause damage. Props must be stored securely and protected from moisture, extreme temperatures, wind, and unauthorised handling at all times. Any damage or loss resulting from improper storage or negligence while the props are in the Client’s care will be the Client’s full responsibility and may be deducted from the damage deposit or invoiced separately if costs exceed the deposit amount.

6. Liability and Insurance
6.1 Client Liability:
The Client is responsible for any loss, damage, or injury caused by the props to the Client, event guests, or third parties. Eveia Occasions will not be held liable for any injury, loss, or damage resulting from the use of the props.
6.2 Insurance:
The Client may be required to provide proof of event insurance covering the props during the rental period. If the Client does not have insurance, Eveia Occasions may offer an insurance option for an additional fee.

7. Substitution and Availability
7.1 Substitution of Props:
If any of the props booked become unavailable or are damaged prior to the event, Eveia Occasions reserves the right to substitute them with similar props of equal or greater value. The Client will be notified of any substitutions in advance.
7.2 Availability:
While Eveia Occasions will make every effort to ensure that the props are available as agreed, availability is subject to prior bookings. If any item is unavailable, Eveia Occasions will inform the Client as soon as possible and offer suitable alternatives.

8. Power Requirements and Site Logistics
For any props or installations requiring access to electricity (including but not limited to illuminated signage, powered displays, or other electrical equipment), the Client is solely responsible for ensuring that:
8.1 Adequate Power Supply:
A safe, accessible, and fully operational power source is available at the event location at the time of setup and throughout the event duration.
8.2 Advance Notification:
The Client must notify Eveia Occasions in writing at least 14 days prior to the event of all relevant site logistics, including but not limited to the location of available power outlets, distance from setup area to the nearest power source, and any specific venue restrictions or requirements related to electrical usage.
8.3 Compliance and Permissions:
The Client is responsible for obtaining any necessary permissions or approvals from the event venue regarding the use of electrical equipment.
8.4 Liability:
Eveia Occasions shall not be held liable for any failure to deliver or operate powered props or equipment if the Client fails to provide accurate site information or if the power supply is unavailable, insufficient, or non-compliant with venue regulations.
8.5 Additional Costs:
If additional equipment (such as extension cords, power adaptors, or generators) is required due to insufficient site preparation, the Client may incur additional charges.

9. Force Majeure
Neither party will be held liable for failure to perform its obligations under this agreement if such failure is caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, governmental restrictions, or other unforeseen circumstances.

10. Data Protection
Eveia Occasions will treat all personal data provided by the Client as confidential and will use it only for the purposes of fulfilling this agreement. The Client agrees to the collection and use of their personal data for processing the rental, as well as for future marketing or promotional activities (if applicable).

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Surrey.
